I recently came off a 2.5-week tour and luckily got to enjoy Thanksgiving with my family. Soon after, they went back to work or school and I was left on my own for a few days. While looking through the mail, I found the Christmas copy of the American Muscle Catalog. As l gazed at the cover adorned with a beautiful, red, 2024 Mustang, parked in front of snow-capped mountain range, I thought…wow, that car looks pretty badass. As I took a closer look, the car began to look strangely familiar to me. Was it the color? The rims? The stance? What is it? Then it dawned on me that it was my car. I dug through my phone to find the original photo I took after completing the suspension in my garage and confirmed it. Every intricate detail within every reflection proved it was my photo of my car. At first I was flattered thinking, “Wow, they like my work, whether it be the car or the angle of the photo.” Then I was like “WTF?” Thoughts?

note: as many things as i know how to do, i dont know how to be a lawyer. this is not legal advice, but this is what i would do

sounds like a good ol case of copyright infringement to me.

firstly, make sure there isnt some hidden credit somewhere to you for the original picture. save that original picture with all the metadata and that copy of their magazine somewhere safe..
secondly, if you wish to pursue this, get in contact with a lawyer and have them help you. copyright is complex, so its best to get someone to help you who knows what they are doing in that regard.

if they did this to a Mustang7G member, who knows what other nonsense they have pulled with other peoples' pictures. dont let them just get away with it, because they will do it again if they think they can

What is the crime in all of this?
using a picture someone else took without their permission is copyright infringement, because the person who originally took the picture owns the copyright to that picture

AM has reached out to me previously with $200 store credit option for me to share my product installation video and pics. But this is terrible and daylight robbery. Can’t believe a company would go this LOW in stealing someone else work as their own. SHAME

Not if they throw it upon the internet on websites that claim anything posted is theirs.

Well, they did take out the 5.0 and the flag under them, but that doesn't excuse them from copyright infringement. Yes, ask your lawyer, but the truth is, even if you win the award will not be worth the effort. Unless of course, it is an ego thing which is the reason in the first place.

My advice? Save your money, but ask them for a huge discount!

How did they get a hold of your photo?
I posted it on a 7g thread and have used it as my profile pic as well. I also posted it at American Muscle because I bought some parts from them and left a review. That isn’t to say I gave them permission to use it as a cover shot on a magazine. I’m not a professional photographer. I just got lucky with the angle on this shot. Be that as it may, if you’re gonna use somebody’s work, leave it as it were and shoot a thank you email. Don’t be a scumbag and photoshop the crap out of it in hopes no one will notice. That makes it look like you intentionally stole it.

For those of us with custom S650’s in our garages, nobody is gonna buy the poor Tiny Tim routine, so it’s not about the money. Yesterday, I got my ass handed to me drag racing a geriatrics patient. He looked a lot like Santa Claus and drove a stock 2019 Corvette. His car hooked, and I spent the race creating a cloud of smoke, drifting side to side, two car lengths behind him. At the light, he said, “Your car sounds awesome though.” Whatever ego I had left is in the rearview mirror. 😂
Principle, yeah. Discounts? I like discounts.

I'm not a lawyer, but I think that if you post anything to a corporate or business website you are most likely giving implicit permission for them to use your post and photo. It's probably buried in the fine print somewhere on their site that says something like; that by posting on our site, anything that you post here is ours to use as we see fit.

Just my opinion so don't shoot me!
